1. General Terms and Conditions

1.1 The Surakas OÜ online store / e-shop sells products (hereinafter Products) manufactured and brokered by Surakas OÜ.

1.2 The Terms and Conditions apply to legal relations that arise between the Customer (hereinafter the Customer) and the owner of the shopping environment Surakas OÜ (hereinafter the Seller) located at the Internet address www.surakas.ee in connection with the purchase of Products from the online store. In addition to these terms and conditions, the legal relations arising from the purchase of Products from the online store are regulated by the legislation in force in the Republic of Estonia.

1.3 The Seller may change the terms of use of the online store and the prices of products and services. The seller announces the changes on the website www.surakas.ee. The terms and prices valid at the time of the transaction are applied to the transaction.

2. Prices

2.1 All prices displayed in the online store are in euros and include VAT.

3. Products

3.1 The Products displayed in the Online Store are generally in stock. Product availability is not guaranteed as it may be erroneous due to possible technical issues with the programs.

3.2 If the customer places an order, but it turns out that the seller of the Product does not have it, the online store will not be able to fulfill this order. In this case, the full purchase amount will be returned to the Customer as soon as the absence of the Product becomes clear.

3.3 Photographs of the Products displayed in the Online Store are for illustrative purposes only and may differ slightly or unintentionally from the actual appearance of the Product.

4. Making a purchase

4.1 The goods can be ordered by a person at least 18 years old.

4.2 The Customer selects the desired Product in the online store and adds it to the shopping cart.

4.3 In order to place an order, the Customer must fill in the required data fields.

4.4 The amount that can be paid via the bank link is then displayed on the screen.

4.5 After paying for the Product, the online store will send an order confirmation to the Customer's e-mail.

4.6 When placing an order, the Customer provides the necessary and true data for the execution of the order.

4.7 The Seller shall not be liable for the impossibility of performance due to incorrect information provided by the Customer during the performance of the order or for any consequences arising therefrom.

4.8 The Seller has the right to refuse to fulfill the order if there is any doubt as to the accuracy of the information provided to the Seller and in the event of conduct not in accordance with good practice.

4.9 When ordering goods to the parcel machine, the parcel will be issued only between 10:00 and 22:00 to a person identified with an ID card who is an adult.

5. Payment methods

5.1 Orders can be paid for securely using Estonian bank links (Swedbank, SEB, LUMINOR, LHV, Coop).

5.2 The payment is made outside the online store environment in the secure payment environment of the service provider Esto AS.

5.3 The Seller does not have access to the Customer's bank data.

5.4 Surakas OÜ is the chief processor of personal data. Surakas OÜ forwards the personal data necessary for making payments to the authorized processor Esto AS.

6. Delivery

6.1 The Customer can choose between different methods of delivery of the Product. The arrival of the product depends on the service chosen by the Customer.

6.2 By choosing the Itella SmartPOST parcel machine as the method of delivery, the Product will reach the parcel machine chosen by the Customer within 2-4 working days as of the receipt of the payment to the current account of Surakas OÜ.

6.3 The Customer shall be notified of the arrival of the Product at the parcel machine by an SMS message containing the door code. NB! In addition to the code, it is also necessary to insert your ID card into the SmartPOST parcel machine. It is possible to redeem goods from the SmartPOST parcel machine between 10.00 and 22.00.

6.4 The product is stored in the parcel machine for 7 calendar days. After the expiration of this term, the Product will be sent back to the online store. If the Customer does not pick up the Product within the aforementioned term, the Customer is obliged to reimburse the costs related to the return and other costs that may arise.

6.5 It is possible to order SmartPOST in the quantity of goods that can be packed in the maximum dimensions: 60 cm * 36 cm * 60 cm. Maximum weight: 35 kg. If it is not possible to pack the ordered quantity in the given dimensions, you must use a courier service to receive the goods.

6.6 SmartPOST parcel machines are located in various shopping centers all over Estonia. You can choose the one that suits you.

6.7 The Seller shall not be liable for any damage caused to the Customer if, for reasons beyond the Seller's control, third parties have received a unique code of the parcel machine and the goods have been received on the basis thereof.

6.8 If the delivery of the order fails due to the incorrect contact information entered by the customer or the customer being under 18 years of age, the amount paid by the customer minus the transport costs incurred will be refunded to the customer.

6.9 If the Customer has placed an order on a weekend (in the period after 13.00 on a Friday until 09.00 on a Monday) or on a public holiday, the term of 5 working days shall take effect on the first working day following the weekend or public holiday at 09.00.

6.10 The Customer is obliged to check the correctness of the contact information provided before placing an order in order to avoid delays and misunderstandings during the delivery of the Products. The Seller is not responsible for delays and misunderstandings during the delivery of the Products, if the delay or misunderstanding is due to the inaccuracy or correctness of the information provided by the Customer when placing the order.

6.11 If the Product does not reach the Customer in good condition and in a sealed package, the Customer is obliged to inform the online store by sending a corresponding letter to the e-mail address: info@surakas.ee or by calling +372 517 9595.

7. Right of withdrawal

7.1 In accordance with the legislation of the Republic of Estonia and the European Union, the consumer's right to withdraw from the contract and return the goods does not extend to alcoholic beverages.

7.2 If the goods are incorrect or defective, you must notify us immediately upon receipt of the goods at the e-mail address info@surakas.ee or call the contact telephone. You can exchange the wrong or defective goods on the basis of the invoice. The costs of return are borne by Surakas OÜ.

7.3 The online store has the right to withdraw from the sale transaction and reclaim the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.

8. Procedure for submitting claims

8.1 The 2-year term for submitting claims provided for in § 218 (2) of the LPA applies to the Products sold.

8.2 In case of non-compliance or defects of the product, the Customer undertakes to notify the Seller immediately, but not later than within 2 months after the occurrence of the defect, by sending the buyer's contact information, exact description of the problem and purchase receipt number to info@surakas.ee. If a product defect occurs, please stop using the product immediately.

8.3 All claims will be reviewed, and the Client will be contacted as soon as possible, but no later than within 15 days from the receipt of the claim.

8.4 In the event of non-compliance of the goods with the terms of the contract, the customer may rely on the legal remedies provided by law, including demanding the fulfillment of the contract, lowering the price, demand compensation for damage and canceling the contract.

8.5 In the event of non-compliance of the Product with the terms of the contract, the costs related to the repair or replacement of the Product, in particular transport, postage, labor, travel and material costs, shall be borne by the online store.

8.6 The Online Store is not liable for damages caused by improper use of the ordered products, as well as for delays in delivery, if this is due to circumstances beyond the control of the Online Store and / or due to force majeure beyond its control.

8.7 The Online Store does not reimburse the expenses incurred by the Customer in case of non-compliance or defects of the product and is not responsible for them: the value of the product has decreased / the product has been damaged due to the customer's fault, defects have occurred due to non-intended use of the product, there is no document certifying the purchase.

9. Liability

9.1 The Seller and the Customer shall be liable to each other for the damage caused to the other party by the violation of these Terms of Use in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

9.2 The Seller is liable to the extent of the sales price of the Product.

9.3 The Customer undertakes to use the online store service only for purposes in accordance with law and good practice.

10. Terms of use and their changes

10.1 By making a purchase in the online store, the Customer agrees to the terms of use of the online store and undertakes to comply with them.

10.2 The sales contract between the Seller and the Customer will come into force upon receipt of the purchase amount payable to the Seller's current account.

10.3 The Seller may change the terms of use of the online store and the prices of the products. Notice of changes is published in the online store environment. The terms and prices valid at the time of the transaction are applied to the transaction.

10.4 The Seller has the right to cancel the order if the price of the Product displayed in the online store was incorrect due to a technical error.

11. Other conditions

11.1 Disputes between the Customer and the Seller shall be resolved through negotiations.

11.2 If the Seller has refused to resolve the Customer's complaint or the Customer does not agree with the solution offered by the Seller and finds that his rights or interests have been violated, the Customer may submit a complaint to the Consumer Complaints Commission through the Consumer Protection Board or to a court. Contacting the Commission is free of charge for the consumer and the value of the transaction must be more than 20 euros. The customer can file a complaint himself or through a representative. The data of the Consumer Protection Commission are presented on the website of the Consumer Protection Board.

PRIVACY POLICY

1. Surakas OÜ is committed to protecting the privacy of customers and users. Accordingly, we have established this Privacy Policy for the collection, use, disclosure, transmission and storage of customer data. Our activities on the Internet are in accordance with all relevant activities and the relevant legislation of the European Union and the laws of the Republic of Estonia.

2. Collection and use of personal data. Personal data is your data, which is specifically or indirectly related to an individual, which Surakas OÜ collects and processes in order to fulfill an agreement entered into with an individual or to contact him or her and to fulfill obligations arising from law. In order to make payments, we forward the necessary personal data to the authorized processor of Esto AS.

3. Personal data we collect are name, personal identification code, address, telephone number, e-mail and purchase history.

4. Use and storage of collected personal data. By agreeing to the terms and conditions of the Privacy Policy, the customer gives consent to Surakas OÜ for the automated processing of his or her data. You can always withdraw your consent via our website or by submitting a statement in a form that can be reproduced in writing. The application or withdrawal of consent shall not have retroactive effect. In order to better serve the customer, Surakas OÜ may disclose information about individual users to a third party who provides Surakas OÜ services and is contractually obliged to keep the shared information confidential. A third party is, for example, our partner, whose tasks are to transport goods or other services sold in the online store. Surakas OÜ retains the customer's personal data until the termination of the contract.

5. The data that Surakas OÜ is required to retain pursuant to legislation (eg accounting data) shall be retained by Surakas OÜ pursuant to the requirements provided by legislation. Personal data is used to manage customer orders and deliver goods. Consent to the processing of personal data is necessary for the management of orders and orders cannot be submitted without it. Purchase history data (purchase date, goods, quantity, customer data) is used to compile an overview of purchased goods and services and to analyze customer preferences.

6. The bank account number is used to return payments to the customer. Personal data such as first and last name, personal identification number, telephone number and e-mail address are processed in order to resolve issues related to the provision of goods and services (customer support). The IP address or other network identifiers of the online store user are processed to provide the online store as an information society service and to compile online usage statistics.

7. Protection of personal data. Surakas OÜ applies all precautionary measures (incl. Administrative, technical and physical measures) to protect the customer's personal data. Only authorized persons have access to modify and process the data. If you suspect that your personal information has been compromised as described in this Privacy Policy or that there is a risk that your information may have been leaked to third parties, please let us know immediately. Only in this way can we keep the potential damage to a minimum.

8. The customer has the right to demand the termination of the processing of his data, information on the use of the data and the transfer of the data to himself or a third party in a publicly available format. In order to prevent the misuse of the Client's data and rights, applications may be submitted only in a form where the identity of the applicant is identifiable (digitally signed). We have the right to respond to such requests within 30 days.

9. Security. All personal data of the customer that has become known during the visit to the Surakas OÜ online store and the performance of purchases are treated as confidential information. An encrypted data communication channel with banks ensures the security of the purchaser's personal data and bank details.

10. Privacy Policy Terms and Changes. By using our website, you have read and agreed to these terms and conditions. We reserve the right to change the general terms and conditions of the privacy policy, if necessary, by informing all customers, but we will do our best to keep our privacy policy up-to-date and available to you on our website.
